Terms of service

The acceptable use policy and the privacy policy are part of these terms and are linked, not restated.

1. Who we are

The Service is an application programming interface that runs open-weight language models at api.creeksidecompute.ai, and the account pages at creeksidecompute.ai/account. It is provided by Creekside Compute Inc., based in Canada ("Creekside Compute", "we"). These terms apply to every use of the Service with a key we issue. Access through a partner platform is also governed by that platform's terms.

2. Who may use it

You must be at least 18, and able to accept these terms for yourself or for the organisation you represent. The Service is for developers and businesses building software. One person or organisation per account.

3. Accounts and keys

You sign in with your email address. A key is shown once, when you make it; we keep only a hash of it. You are responsible for every request made with your keys and for keeping them secret. If a key is exposed, revoke it on the account page; it stops working within 30 seconds.

4. Acceptable use

The acceptable use policy at https://creeksidecompute.ai/content-policy is part of these terms. In short: no sexually explicit content on keys we issue; never sexual content involving minors or uplift toward weapons; no reselling access without a written agreement; no attempts to get around rate limits, credit checks or billing, or to extract model weights.

5. Prepaid credit and prices

  • You buy credit in advance by card, through our payment processor, Stripe. We never see or store card numbers.
  • Each request is charged at the prices published at GET /v1/models and on https://creeksidecompute.ai/#pricing when the request is made, per million input, cached input and output tokens.
  • A request is refused with HTTP 402 when your credit will not cover it. Requests in flight when credit runs out may take the balance a few cents below zero; the next purchase repays that first.
  • Requests we refuse (402, 429 or 503) are not charged. A reply cut off before the end is charged for the text delivered.
  • Credit does not expire. Unused credit is refundable on request within 30 days of purchase; after that it is not refundable, except where the law requires or where we close your account for a reason other than fraud or a breach of these terms.
  • We may change prices with 14 days' notice on the pricing page. Changes never apply to requests already made.
  • Prices exclude taxes. Where we are required to charge tax, it is added at purchase.

Customers under a direct agreement are invoiced as that agreement says.

6. Your data

The privacy policy at https://creeksidecompute.ai/privacy says what we keep. By default we do not store the content of requests or responses. If you choose the retained tier for a key or a request, you grant us the licence the privacy policy describes, and the lower price is the consideration for it. You own your inputs and outputs. Model outputs are provided as they are and may resemble outputs produced for others.

7. Availability

We aim for the endpoint to be available at least 99.5% of each month, but at these prices we give no uptime guarantee. We may suspend the Service for maintenance or to protect it.

8. Suspension and closing an account

You may close your account at any time by writing to [email protected]. We may suspend a key or an account that breaches these terms, as the acceptable use policy describes, and close it for a serious or repeated breach. We may close any account with 30 days' notice, refunding unused credit.

9. Warranties and liability

The Service is provided "as is" and "as available". To the extent the law allows, we exclude all implied warranties, and our total liability for any claim is limited to the amount you paid us in the three months before it. We are not liable for indirect or consequential loss, or for the content of model outputs.

10. Changes, law and contact

We may change these terms by posting a new version with a new effective date; material changes take effect 14 days after posting, and continuing to use the Service after that is acceptance. These terms are governed by the laws of the province of Canada in which Creekside Compute Inc. has its registered office, and the federal laws of Canada that apply there. Contact: [email protected].
